Every piece of content must carry #ad, #sponsored, or Instagram / TikTok's native "Paid Partnership" tag at the top of the caption. Non-negotiable under US FTC guidelines. Creator is responsible for disclosure; Bumpskē is protected because it's in writing.
Creator submits rough cut at least 48 hours before scheduled posting. Bumpskē team has 24 hours to respond. Up to 2 rounds of revisions allowed, limited to brand-compliance issues - logo visibility, product usage, disclosures. Creator retains final creative voice on everything else.
If Bumpskē cancels after contract signing but before content creation: 25% kill fee paid to creator. If cancelled after content creation but before posting: 50% kill fee. Creator retains product in both cases. If creator cancels without cause: product returned, no payment owed. Force majeure clauses apply (illness, family emergency, platform outages).
Tier 1 & 2 creators deliver raw, unedited clips + 3-5 B-roll shots via WeTransfer or Google Drive within 48 hours of the Reel going live. This gives Bumpskē re-cut rights for performance ads, TikTok variations, and A/B testing without a re-shoot. Tier 3 can add this for +$50.
Content goes live only during Tue-Sat, between 10am-8pm in creator's local timezone. No late-night drops, no Sunday/Monday burials. Bumpskē and creator mutually agree on exact date in the brief. Creator cannot post earlier than agreed without written approval.
Every creator gets both: a personalized affiliate discount code (20% off, tracks revenue) and a UTM-tagged landing page URL (tracks traffic, bounce rate, add-to-cart). Story link stickers, TikTok bio links, and YouTube descriptions all use the UTM URL. This gives us two independent attribution signals, not just one.
Creator must send performance screenshots at Day 7 and Day 28 post-live, covering: views, likes, comments, shares, saves, story tap-throughs, and reach. UNV Digital compiles a combined report for Bumpskē covering code redemptions + UTM traffic + creator-reported engagement. This is how we decide round 2 and inform the next cohort's tier assignments.
Creator agrees not to publicly criticize, mock, or disparage Bumpskē, its products, its team, or its other creators for 12 months after the collaboration ends. Applies to social posts, interviews, podcasts, and comments. Does not prevent honest product feedback given privately to Bumpskē or UNV Digital.
If creator becomes subject to a public scandal, criminal charge, or significant reputation event that could reasonably harm the Bumpskē brand, Bumpskē reserves the right to: (a) pull all content immediately, (b) cease paid ad usage, (c) withhold unpaid fees. This is a standard clause in US creator contracts and non-negotiable.
50% on contract signing to lock the creator in and trigger shipping. 50% within 7 days of verified live post - not on delivery of raw cuts, not on posting day alone. This protects Bumpskē from creators who sign, take the product, and ghost. Payment via Wise, Stripe, or bank transfer. Creator provides W-9 (US) or W-8BEN (international) before payment 1.
Any dispute is first resolved through 30-day good-faith negotiation. If unresolved, binding arbitration in Delaware or California (Bumpskē picks based on incorporation). No class actions. Prevailing party recovers legal fees. This is a standard US agency-style clause - keeps things out of court and keeps legal costs predictable.
Clauses 1, 3, 8, 9, 10, 11 live in the signed contract. Clauses 2, 4, 5, 6, 7 live in the creator brief (a 1-pager attached to the contract, easier for creators to digest). Both documents are sent together at Stage 5. Creators who push back on specific clauses get handled at Stage 5 - we have pre-approved negotiation ranges for ad rights duration, exclusivity, and raw footage delivery.
